Central Water Authority (Designation of Catchment Areas) Regulations 1986

[GN 44 of 1986 – 24 May 1986] [Section 49]

1.These regulations may be cited as the Central Water Authority (Designation of Catchment Areas) Regulations 1986.

2. In these regulations –

"maps" means the Directorate Overseas Surveys maps (Reference No. Y. 881) printed by the Government of Mauritius which delimit the various major
and minor catchment areas.

3. The areas specified in Parts I and II of the Schedule shall be major and minor catchment areas respectively.

4. The maps shall be available for inspection by the public during normal office hours at the Central Water Authority's Office.

Central Water Authority (Election of Employees) Regulations 1983

[GN 11 of 1983 – 22 January 1983] [Section 49]

1. These regulations may be cited as the Central Water Authority (Election of Employees) Regulations 1983.

2. In these regulations –

"Act" means the Central Water Authority Act;

"returning officer" means the returning officer appointed by the
Electoral Commissioner.

3. The 2 representatives of the employees of the Authority to be appointed by the Minister under section 7(2)(h) of the Act shall be elected in the manner specified in these regulations.

4. The Board shall provide the Electoral Commissioner with a list of all electors in alphabetical order.

5. (1) Any person who wishes to stand as candidate shall, on such day and at such time and place as may be fixed by the Electoral Commissioner, submit his candidature to the returning officer on a form obtainable from the Authority.

(2) No person shall submit his candidature under paragraph (1) unless it is supported by 10 employees of the Authority who shall affix their signature, thumbprint or mark on the form.

6. The election shall be –

(a) carried out by secret ballot;

(b) conducted by the returning officer;

(c) held at such place and such date and time as the Electoral Commissioner may decide.

7. Every ballot paper –

(a) on which votes are given to more than 2 candidates;

(b) which does not bear the official mark; or

(c) about which there is any uncertainty as to the vote,

shall be void and not counted.

8. The return of the elections shall be the result proclaimed by the returning officer.

Central Water Authority (lrrigation) Regulations 1973

[GN 5 (10) of 1973 – 15 January 1973 ] [Section 49]

1. These regulations may be cited as the Central Water Authority (lrrigation) Regulations 1973.

2. In these regulations –

"consumer" means any person to whom the Authority has agreed to supply water for irrigation purposes;

"water works" means the different systems of canals, conduits, mains, pipes, wells, dams, reservoirs, machine and other appliances of the Authority for supplying and measuring water for irrigation purposes and includes all works, structures, land, rights of way and other appurtenances held by the Authority for the purpose of carrying into effect the provisions of these regulations.

3. (1) Any person wishing to obtain water for irrigation purposes shall make an application in the form set out in the First Schedule.

(2) Where the applicant is a lessee of the premises for which the supply is required, the applications shall be made jointly by him and the owner of the land.

(3) The applicant shall furnish to the Authority such further information, including documents and site plans as the Authority may require.

(4) On receipt of an application under paragraph (1), the Authority may cause
the lands to be inspected, and shall, when the Authority decides to grant the application, determine, in consultation with the applicant, the manner in which the water will be supplied.

4. The applicant shall be responsible for the construction of channels or pipelines from the delivery point.

5. Where any part of the water works passes across the land to which water is to be supplied, water may be supplied from a delivery point on that land.

6.(1) The Authority shall endeavour to supply continuously to a consumer water at a minimum output of one three hundred and fiftieth of a cubic metre per second.

(2) The amount of water supplied shall be measured in such manner as the Authority may determine.

(3) The Authority shall construct, maintain and operate the required channels and pipelines from the Authority's reservoir to the delivery point.

(4) Several delivery points may be constructed in respect of the lands of the same applicant.

7.(1) A consumer may discontinue his supply of water by giving one week's written notice thereof to the Authority.

(2) Where a consumer –

 (a) commits an offence under these regulations;

 (b) fails to pay the water charges due by him within 21 days of the service of a notice of claim;

 (c) fails to pay, within such time as may be specified in a notice to that effect any other sum due to the Authority under these regulations,

the Authority may discontinue to supply water in respect of any or all of the water supplies of that consumer.

(3) Where a consumer whose supply has been discontinued pursuant to this regulation wishes to restore the water supply, the Authority –

 (a) may, in the case of a discontinuance under paragraph (1); and

 (b) shall in the case of a discontinuance under paragraph (2),

require the consumer to submit a fresh application.

8. (1) Where the volume of water consumed in a month by a consumer is less than 25 per cent of the volume of water agreed to be supplied to him by the Authority, the consumer shall be deemed to have consumed 25 per cent of the volume of water agreed to be supplied to him by the Authority.

(2) Every consumer shall, in respect of each month, pay –

 (a) the water rates specified in the Second Schedule; and

 (b) a rent of 50 rupees for any meter or measuring device installed by the Authority for his water supply.

(3) Every consumer who fails to pay his water charges within 21 days of the date of issue of a notice of claim to that effect shall be liable to pay a surcharge of 10 per cent of the amount specified in the notice.

9. Any person who –

(a) in an application made under these regulations or in answer to a request made by the Authority under regulation 3(3), makes any false statement;

(b) withdraws water from the water works without the consent of the Authority;

(c) breaks, damages, tampers with or obstructs the water works;

(d) fishes or attempts to fish in any water works without the consent of the Authority;

(e) bathes or washes any person or thing in the water works,

shall commit an offence.
