Order made by the Commissioner of Police under section 13A of the Police Act

[GN 8 of 2011 – 22 January 2011] [Section 13A]

1. Notice is hereby given that by virtue of the powers vested in me under section 13A of the Police Act, I have deemed it necessary in the interests of public safety and public order, to order that the portion of land forming part of the Mauritius Broadcasting Corporation, Headquarters, Reduit, and more fully described in the Schedule shall be a protected area.

2. The only persons entitled to enter and leave the protected area are those who have been authorised –

(a) in writing by the Director-General of the Mauritius Broadcasting Corporation; or

(b) by the Commissioner of Police.

3. Any police officer may arrest any person who unlawfully attempts to enter the protected area, or arrest and remove any person who is found in the area without lawful authority.

4. Any person who, without lawful authority, enters or remains in the protected area shall commit an offence and shall, on conviction, be liable to a fine not exceeding 10,000 rupees and to imprisonment for a term not exceeding 2 years.

SCHEDULE

[Paragraph 1]

The area comprising of a portion of land of an extent of 3.6445 ha, being part of State Land at Reduit, in the District of Moka and is bounded as follows –

(a) towards the North by the sinuosity of Feeder Bonair on a developed length of 212 metres, starting from Point 1 (552,256.93mE, 7,763,122. 11mN) to Point 9 (552,427.60mE, 7,763,125.04mN);

(b) towards the East by a road (Boundary Road) along a straight line measuring 171 metres and 15 centimetres (171.15 m) running from Point 9 (552,427.60mE, 7,763,125.04mN) up to Point 8 (552,510.73mE, 7,762,975.44mN);

(c) towards the South by State Land being road reserves of Moka – Camp des Masques – Flacq road (A7), on 2 straight lines measuring 74 metres and 67 centimetres (74.67 m) and 63 metres and 14 centimetres (63.14 m) respectively and is defined by Point 8 (552,510.73mE, 7,762,975.44mN), Point 7 (552,467.07mE, 7,762,914.86mN) and Point 6 (552,420.52mE, 7,762,872.20mN);

(d) towards the West by State Land being road reserves of Port Louis – Plaisance dual carriageway (MI), on 5 straight lines measuring 39 metres and 20 centimetres (39.20 m), 55 metres (55.00 m), 50 metres and 70 centimetres (50.70 m), 104 metres and 65 centimetres (104.65 m), and 59 metres and 60 centimetres (59.60 m) respectively and is defined by Point 6 (552,420.52mE, 7,762,872.20mN), Point 5 (552,384.90mE, 7,762,888.60mN), Point 4 (552,372.77mE, 7,762,942.25mN), Point 3 (552,352.23mE, 7,762,988.63mN), Point 2 (552,295.28mE, 7,763,076.46mN) and Point 1 (552,256.93mE, 7,763,122.11mN).

Order made by the Commissioner of Police under section 13A the Police Act

[GN 49 of 2009 – 29 May 2009] [Section 13A]

1. Notice is hereby given that by virtue of the powers vested in me under section 13A of the Police Act, I consider it necessary, in the interest of public safety and public order, to order that the plot of land opposite the Prime Minister's residence, situate at Le Mesnil, St Paul, Phoenix, in the district of Plaines Wilhems, more fully described in the Schedule, shall be a protected area.

2. The only persons entitled to enter and leave the protected area are those who have been authorised in writing by the Commissioner of Police.

3. A police officer or member of the armed forces may –

(a) take such measures as he considers necessary to ensure that no person prohibited from entering or remaining in the protected area enters or remains in that area;

(b) arrest and remove any person who unlawfully attempts to enter the protected area;

(c) arrest and remove any person who is found in the protected area without any lawful authority.

4. Any person who, without lawful authority, enters or remains in the protected area shall commit an offence and shall, on conviction, be liable to a fine not exceeding 10,000 rupees and to imprisonment for a term not exceeding 2 years.

SCHEDULE

[Paragraph 1]

The protected area shall comprise of a portion of land of an extent of 5,870 square metres situate at Le Mesnil, St Paul, Phoenix, in the district of Plaines Wilhems and more fully described as follows –

(a) (i) towards the North by 118.41 metres from the property of Mr Jayraj Benydin;

 (ii) towards the West by 52.50 metres from the bend of Rivière Sèche;

 (iii) (A) towards the South by 43.38 metres from the property of Messrs Golam Mohamed, Dhuny and others;

  (B) towards the South by 63.18 metres from the boundary of sundry owners;

 (iv) (A) towards the East by 22.95 metres from Avenue Premchand Mounshi;

  (B) towards the East by 48.75 metres from Tagore Road on the boundary of sundry owners,

(b) and shall include –

 (i) that part of Tagore Road which is adjacent to the portion of land described above and which ends with the river reserve of Rivière Sèche; and

 (ii) that part of the river reserve and of Rivière Sèche which are adjacent to the end of that part of Tagore Road.

Order made by the Commissioner of Police under section 13A of the Police Act

[GN 52 of 2009 – 1 June 2009] [Section 13A]

1. Notice is hereby given that by virtue of the powers vested in me under section 13A of the Police Act, I consider it necessary, in the interest of public safety and public order, to order that the plots of land –

(a) at River Walk, Floreal, on which stands the Prime Minister's residence; and

(b) at Vacoas, on which stands Clarisse House, in the district of Plaines Wilhems, more fully described in the First and Second Schedules, respectively, shall be protected areas.

2. The only persons entitled to enter and leave the protected areas are those who have been authorised in writing by the Commissioner of Police.

3. A police officer or member of the armed forces may –

(a) take such measures as he considers necessary to ensure that no person prohibited from entering or remaining in the protected areas enters or remains in those areas;

(b) arrest and remove any person who unlawfully attempts to enter the protected areas;

(c) arrest and remove any person who is found in the protected areas without any lawful authority.

4. Any person who, without lawful authority, enters or remains in the protected area shall commit an offence and shall, on conviction, be liable to a fine not exceeding 10,000 rupees and to imprisonment for a term not exceeding 2 years.

FIRST SCHEDULE

[Paragraph 1]

The protected area shall comprise of 2 contiguous plots of land situate at River Walk, Floreal, in the district of Plaines Wilhems and more fully described as follows –

(a) the first portion of the extent of 4448 and 57 hundredths square metres (4448.57 m2) bounded as follows –

 (i) towards the North East by the sinuosities of Rivière Sèche;

 (ii) towards the South East by the property belonging to George Mayer or assigns on 87 metres and 65 centimetres (87.65 m);

 (iii) towards the South West partly by the property belonging to Alain Wiehe or assigns and partly by the property belonging to Jean Alain Lalouette or assigns on 53 metres and 61 centimetres (53.61 m);

 (iv) towards the North West by the second portion hereinafter described on 86 metres and 43 centimetres (86.43 m);

(b) the second portion of the extent of 709 and 49 hundreds square metres (709.49 m2) bounded as follows –

 (i) towards the North East by the sinuosities of Rivière Sèche;

 (ii) towards the South East by the first portion described above on 86 metres and 43 centimetres (86.43 m);

 (iii) towards the South West by the property belonging to Jean Alain Lalouette or assigns on 6 metres and 93 centimetres (6.93 m);

 (iv) towards the North West by the property belonging to Jose Tennant or assigns on 87 metres and 65 centimetres (87.65 m).

The protected area shall comprise of a plot of land of an extent of 10 hectares 1020 square metres (10 ha 1020 m2) situate at Vacoas, in the district of Plaines Wilhems and bounded as follows –

(a) towards the North-east partly by State land (former War Department Land) on 2 lines measuring 138 metres and 50 centimetres (138.50m) and 40 metres and 75 centimetres (40.75 m), respectively and partly by private properties on 8 lines measuring 127 metres and 66 centimetres (127.66 m), 20 metres and 97 centimetres (20.97 m), 74 metres and 52 centimetres (74.52 m), 12 metres and 78 centimetres (12.78 m), 38 metres and 10 centimetres (38.10 m), 70 metres and 89 centimetres (70.89 m), 40 metres and 60 centimetres (40.60 m) and 71 metres and 47 centimetres (71.47 m), respectively;

(b) towards the South-east by River Walk Avenue on 196 metres and 39 centimetres (196.39 m);

(c) towards the South-west partly by private properties on 6 lines measuring 88 metres and one centimetre (88.01 m), 55 metres and 36 centimetres (55.36 m), 75 metres and 23 centimetres (75.23 m), 64 metres and 46 centimetres (64.46 m), 128 metres and 92 centimetres (128.92 m) and 12 metres and 85 centimetres (12.85 m), respectively, and partly by State land (former War Department Land) on 146 metres and 25 centimetres (146.25 m);

(d) towards the North West by Saint Paul Road (B4) on 177 metres and 85 centimetres (177.85 m).`

Order made by the Commissioner of Police under Section 13A the Police Act

[GN 285 of 2013 – 30 November 2013] [Section 13A]

1. Notice is hereby given that by virtue of the powers vested in me under section 13A of the Police Act, I consider it necessary, in the interest of public safety and public order, to order that the portion of land forming part of the Gallery Range of the Mauritius Police Force situate at Midlands (Dubreuil), in the district of Moka, more fully described in the Schedule, shall be a protected area.

2. The only persons entitled to enter and leave the protected area are those who have been authorised in writing by the Commissioner of Police.

3. A police officer or member of the armed forces may –

(a) take such measures as he considers necessary to ensure that no person prohibited from entering or remaining in the protected area enters or remains in that area;

(b) arrest and remove any person who unlawfully attempts to enter the protected area;

(c) arrest and remove any person who is found in the protected area without any lawful authority.

4. Any person who, without any lawful authority, enters or remains in the protected area shall commit an offence and shall, on conviction, be liable to a fine not exceeding 10,000 rupees and to imprisonment for a term not exceeding 2 years.

[Paragraph 1]

The protected area shall comprise a portion of State land of an extent of 139 hectares five thousand three hundred and sixty square metres (139 h, 5,360m2) being part of State land Brun, Massogne and Lagoniviere bearing PIN 1519150058 situate at Midlands (Dubreuil), in the district of Moka and more fully described as follows –

(a) towards the North by a road on a developed length of eight hundred and seventy-seven metres and fifty centimetres (877.50m);

(b) towards the East partly by surplus of State land Brun, partly by surplus of State land Massogne and partly by surplus of State land Lagoniviere on 2 lines measuring nine hundred and ninety-six metres (996.00m) and five hundred and thirty-one metres and fifty centimetres (531.50m), respectively;

(c) towards the South along a line following the ridge of Mountain Lagrave on a developed length of one thousand eight hundred and sixty-four metres (1,864.00m); and

(d) towards the West partly by surplus of State land Massogne and partly by surplus of State land Brun on 2 lines measuring four hundred and forty-nine metres and fifty centimetres (449.50m) and nine hundred and eighty two metres (982.00m), respectively.

1. Notice is hereby given that by virtue of the powers vested in me under section 13A of the Police Act, I have deemed it necessary, in the interests of public safety and public order, to order that the portion of land forming part of the Mauritius Broadcasting Corporation, Forest Side, and more fully described in the Schedule shall be a protected area.

2. The only persons entitled to enter and leave the protected area are those who have been authorised in writing by the Director-General of the Mauritius Broadcasting Corporation or the Commissioner of Police or any person authorised by him.

3. Any police officer may arrest any person who unlawfully attempts to enter the area or arrest and remove any person who is found in the protected area without lawful authority.

4. Any person who without lawful authority enters or remains in the restricted area shall commit an offence and shall, on conviction, be liable to a fine not exceeding 10,000 rupees and to imprisonment for a term not exceeding 2 years.
