Protection from Domestic Violence (Hearing of Applications for
Protection, Occupation and Tenancy Orders) Rules 2011

1. Title

These rules may be cited as the Protection from Domestic Violence (Hearing of Applications for Protection, Occupation and Tenancy Orders) Rules 2011.

2. Interpretation

In these rules –

"Act" means the Protection from Domestic Violence Act;

"application" –

(a) means an application under section 3, 3A, 4 or 5 of the Act; and

(b) includes an application made by an Enforcement Officer, on behalf of a victim of an act of domestic violence.

3. Application of rules

These rules shall apply to the hearing of an application for a protection order, an occupation order or a tenancy order under the Act.

4. Applications for orders under the Act

(1) An application for a protection order against a spouse under section 3(1) of the Act shall be in Form A of the Schedule to the Act.
