Waste Water (Cesspit and Septic Tank Emptying Service) (Fees) Regulations 2011

[GN 47 of 2011 – 1 April 2011] [Section 47]

1. These regulations may be cited as the Waste Water (Cesspit and Septic Tank Emptying Service) (Fees) Regulations 2011.

2. In these regulations –

"cesspit or septic tank emptying service" means the pumping and conveyance of effluent to a treatment plant;

"normal working hours" means the hours between 7 a.m. and 4 p.m. from Monday to Friday;

"trip" means the voyage of a cesspit or septic tank emptier from –

(a) its point of operation to the premises where any cesspit or septic tank emptying service is to be provided;

(b) the premises where the cesspit or septic tank emptying service is provided to the nearest treatment plant; and

(c) the treatment plant back to its point of operation.

3. (1) Subject to paragraph (2), any person who uses any cesspit or septic tank emptying service provided by the Authority shall pay to it the appropriate fee specified in the Schedule.

(2) Any person who uses any cesspit or septic tank emptying service outside normal working hours shall pay to the Authority an additional fee of 300 rupees per trip.

Waste Water (Miscellaneous Waste Water Services) (Fees) Regulations 2012

1. These regulations may be cited as the Waste Water (Miscellaneous Waste Water Services) (Fees) Regulations 2012.

2. In these regulations –

"Act" means the Waste Water Management Authority Act;

"blockage" means an obstruction which prevents the smooth running or flow of waste water in the sewers;

"nuisance" means a thing or state of things which –

(a) is or may become injurious or dangerous to public health; or

(b) may hinder the prevention or suppression of disease;

"percolation test" means a subsurface soil test at the depth of a proposed absorption system or similar component on an on-site waste water disposal system to determine the water absorption capability of the soil;

"waste water carrier" has the same meaning as in Waste Water (Registration of Waste Water Carriers and Disposal of Waste Water) Regulations 2006.

3. (1) Every person who –

 (a) is the owner or occupier of a property; and

 (b) wishes to benefit from any of the services specified in the first column of the First Schedule,

shall make an application to the Authority.

(2) The application shall be made in the form set out in the Second Schedule.

4. (1) On receipt of the application made under regulation 3, the Authority shall –

 (a) require the applicant to furnish such further information, including a site plan, as it may require; and

 (b) cause the property to be inspected.

(2) The Authority shall provide the services on payment of the appropriate fee specified in the second column of the First Schedule.

5. Where the Authority is of the opinion that waste water works have to be carried out, the procedure set out at section 40 of the Act shall apply.
