Equal Opportunities (Practice and Procedure of Tribunal) Regulations 2013

1. These regulations may be cited as the Equal Opportunities (Practice and Procedure of Tribunal) Regulations 2013.

2. In these regulations –

"Act" means the Equal Opportunities Act;

"Secretary" means the officer designated as Secretary to the Tribunal under section 37 of the Act.

3. A settlement reached by conciliation under section 32(5) of the Act and embodied in a written agreement shall, within 7 days from the date of the settlement, be forwarded to the Secretary by the Commission for registration with the Tribunal.

4. An interim order issued by the Tribunal, of its own motion or on application made by the Commission, under section 35(1)(b) of the Act shall be in the form set out in the First Schedule.

5. An order or a recommendation made by the Tribunal under section 35(1)(c) of the Act shall be in the form set out in the Second Schedule.

6.  A sworn statement made by a person under section 35(5) of the Act shall be in the form set out in the Third Schedule.

7. An order of the Tribunal requiring the attendance of any person and the production of any document or exhibit under section 36(2)(c) of the Act shall be in the form set out in the Fourth Schedule.

8. A certificate issued by the Secretary under section 39(2) of the Act shall be in the form set out in the Fifth Schedule.

9. The Secretary shall, where the Tribunal has determined a complaint pursuant to section 35(1)(a) of the Act, forthwith –

(a) notify the parties in person of the date of the determination of the Tribunal or forward to them, by registered post, a copy of the determination; and

(b) inform the parties of their right of appeal under section 41 of the Act against any order of the Tribunal.

10. Any party wishing to appeal to the Supreme Court under section 41 of the Act –

(a) may require the Secretary to provide him with a certified copy of the proceedings of the Tribunal; and

(b) shall pay the appropriate fee specified in the Sixth Schedule.

11. (1) The Tribunal shall have an official seal bearing the name of the Tribunal and its contact details.

(2) The seal shall be kept by the Secretary.

(3) Every document issued by the Tribunal shall bear the official seal.

(4) An interim order of the Tribunal under section 35(1)(b) of the Act and an order or recommendation under section 35(1)(c) of the Act shall be signed by the President of the Tribunal.
