Licensing of Recruiting Agents for Overseas Educational and Training Institutions (Application for Licence) Regulations 2006

1. These regulations may be cited as the Licensing of Recruiting Agents for Overseas Educational and Training Institutions (Application for Licence) Regulations 2006.

2. In these regulations –

“Act” means the Licensing of Recruiting Agents for Overseas Educational and Training Institutions Act;

“licensee” means a person who holds a licence issued under section 4(4) of the Act;

“register” means the register referred to in regulation 6(a).

3. For the purpose of –

(a) section 4(2) of the Act, every application for a licence shall be made in the form set out in the First Schedule;

(b) section 4(4) of the Act, every licence issued shall be in the form set out in the Second Schedule;

(c) section 4(5) of the Act –

(i) the fee payable for the issue of a licence shall be 50,000 rupees;

(ii) the security to be furnished by the applicant shall be of the value of 500,000 rupees;

(d) section 4(7) of the Act, the fee payable for the renewal of a licence shall be 50,000 rupees.

4. The supervising officer may make such enquiries as he may determine before issuing or renewing a licence.

5. (1) For the purpose of section 6(1) of the Act, every contract of recruitment shall be drawn up in triplicate, in English or French, and shall contain –

(a) the full name of the student, his date and place of birth and place of residence in Mauritius;

(b) the full name and place of residence of his responsible party;

(c) the name and particulars of the institution;

(d) the proposed field of study;

(e) details of all fees charged by the educational institution;

(f) the fees charged by the licensee for the provision of services;

(g) conditions and costs regarding boarding and lodging abroad;

(h) the duration of the contract, the conditions of renewal of the contract and the grounds on which the contract may be terminated;

(i) the conditions under which entry and residence in the host country are permitted.

(2) A licensee shall keep a copy of every contract of recruitment entered into and shall give a copy –

(a) to the student; and

(b) to the supervising officer.

 

6. Every licensee shall –

(a) maintain a register in such form as the supervising officer may approve, setting out the number of –

(i) applications received for admission to every institution in respect of which it is licensed;

(ii) seats available in every institution in respect of which it is licensed;

(iii) students which it has recruited for admission to every institution in respect of which it is licensed;

(b) exhibit in a conspicuous place at his business premises –

(i) his licence;

(ii) the list of fees payable by students;

(c) neither charge nor receive any fee from students, other than the fees specified in the list referred to at paragraph (b)(ii);

(d) within one month of the first day of each academic year, submit to the supervising officer a return, in the form set out in the Third Schedule, in relation to students recruited;

(e) allow the supervising officer or any officer authorised by him to enter his business premises at any reasonable time for the purpose of inspecting the register or any other document relating to his business.
