Mauritius Bar Association Rules 1957

1. Short title

These rules may be cited as the Mauritius Bar Association Rules 1957.

2. Interpretation

In these rules –

"annual meeting" means the annual general meeting of the members of the Association;

"Chairperson" means the Chairperson of the Council;

"member" means a member of the Association;

"Secretary" means the Secretary of the Association;

"special meeting" means a general meeting of the members of the association, other than an annual general meeting;

"subscription" means the annual subscription fees payable by members;

"treasurer" means the treasurer of the Association;

"year" means the 12 months commencing on 1 January and terminating on 31 December next succeeding, and the expression "financial year" shall be construed accordingly.

3. Annual and special meeting

(1) (a) An annual meeting shall be held, on such date and at such time and place as the Council may determine, once in the month of January every year.

(b) A special meeting shall be held at such other time and place as the Council may, when required so to do by not less than 10 members or at their discretion, determine.

(2) (a) An annual meeting or a special meeting shall be convened by notice addressed by the Secretary to members not less than 15 days before the date fixed for the holding of any such meeting.

 (b) No meeting shall be held to be invalid where a member has not been posted with a notice referred to in subparagraph (a).

(3) (a) Any member wishing to raise any matter at any annual meeting may do so by way of motion, notice of which shall be given in writing to the Secretary not less than 7 days before the date fixed for the holding of such meeting.

 (b) On receipt of a notice, referred to in subparagraph (a), the Secretary shall, subject to the approval of the Chairperson, cause a special notice of such motion to be posted forthwith to members.

(4) No matter other than the matter set out in the convocation notice or special notice, as the case may be, shall be raised or discussed at any such meeting.

(5) At any annual or special meeting, 10 members, 3 of whom shall be members of the Council, shall constitute a quorum.

4. Chairperson to preside over meetings

(1) The Chairperson or, in his absence, the Vice-chairperson, shall preside over any annual or special meeting.

(2) In the absence of the Chairperson and Vice-chairperson at an annual or a special meeting, the members present shall elect a member to act as Chairperson for that meeting.
